*Subject to the Luxury Travel Rewards Lowest Price Guarantee Terms and Conditions
Definitions: Some terms have specific meaning, which are defined within this definitions section, and as otherwise defined within these Luxury Travel Rewards Lowest Price Guarantee Terms and Conditions (the "Guarantee Terms"). Capitalized terms not defined herein shall inherit their associated meaning from the associated Use Terms.
"Apples-to-Apples" means a comparison between an Luxury Travel Rewards Reservation price (after considering the Reservation Price Offsets) and an OTA reservation price, which is considered "Apples-to-Apples" when comparing the same exact Reservation components, including, without limitation, the same accommodations, accommodations category, same occupancy, same traveling party size and ages, same amenities packages, same travel dates, same tax percentages, same travel insurance (if applicable), same cancellation policy, as well as all other Reservation components.
"Confirmed" Reservation means the time when a Member has accepted a Reservation offer and has made the required payment identified by Luxury Travel Rewards, and as defined within the Use Terms.
"General Public" is defined as an online buyer/seller relationship whereby an individual consumer is able to purchase a travel reservation from an OTA without any company, professional, membership, club, association, ownership or enrollment status requirement or other pre-qualifications.
"OTA" means an online travel agency selling reservations by Internet to the General Public.
"Qualifying Membership" means an Luxury Travel Rewards Membership that includes this Lowest Price Guarantee as part of its Membership Benefits.
"Qualifying Reservation" means a Reservation that qualifies to be guaranteed under these Guarantee Terms. Qualifying Reservations include Reservations made by a Member through their associated Qualifying Membership for one of the following types of qualifying accommodations, and unless otherwise determined not to qualify: hotels, castles, apartments, condos, bed & breakfasts, nightly resorts, homes/villas, adventure accommodations, hostels, inns, aparthotels, cruises (ocean, sea, river), tour packages, sports travel packages, custom vacations, and Resort Weeks.
"Savings" means the difference between the lowest price provided by Luxury Travel Rewards after considering all Reservation Price Offsets (i.e. Shared Savings allocation, Life Credit allocation) and the OTA Apples-to-Apples comparison at the time of the Reservation.
The 200% Promise: Luxury Travel Rewards GUARANTEES that each Qualifying Reservation purchased through Luxury Travel Rewards shall be reserved at a Savings. In the event Luxury Travel Rewards should fail to provide a Savings, the Member having made the Reservation is entitled to 200% of the difference in cash. The Luxury Travel Rewards Lowest Price Guarantee shall apply to Confirmed, fully paid Reservations (not a price quote, a hypothetical, etc.). Hotel reservations must be booked 7 days or more in advance as last-minute pricing becomes very volatile. It would be nearly impossible to keep up with the many last-minute price changes as you near check-in. Cruise requests must be requested by filling out cruise request form and submitted to a cruise specialist in order to qualify for the 200% promise.
Savings Challenge: When comparing prices between the Qualifying Reservation price and an OTA reservation price, the only acceptable comparison is one of Apples-to-Apples. In the event a Member believes that Luxury Travel Rewards has failed to provide a Savings, the Member should contact Luxury Travel Rewards by phone and speak with a Travel Manager to verify the OTA price is a Valid Quote. In the event the Member desires to request to be compensated under the Luxury Travel Rewards Lowest Price Guarantee, the Member must notify Luxury Travel Rewards (in writing) of their intention to challenge the Savings (a "Savings Challenge"). A Savings Challenge must be submitted to Luxury Travel Rewards within 24-hours of the date and time the Member has Confirmed the Qualifying Reservation through Luxury Travel Rewards. Members wishing to submit a Savings Challenge must do so in writing by email, using the email subject of "Luxury Travel Rewards SAVINGS CHALLENGE", and emailed to SavingsChallenge@tfccustomercare.com. A Savings Challenge email must include a Valid Quote from the OTA used for the Apples-to-Apples comparison.
Only the Member having made the Reservation is qualified to submit a Savings Challenge. Only a Member associated with a Qualifying Membership "In Good Standing" is qualified to submit a Savings Challenge or qualify for compensation from Luxury Travel Rewards. Reservations purchased for guests of Members shall not qualify for a Savings Challenge when the Member is not included on the same Reservation itinerary.
Valid Quote: The definition of a "Valid Quote" is understood to mean a price quote for an OTA Apples-to-Apples comparison reservation that complies with these Guarantee Terms, and is available to be purchased from a verifiable OTA source. A Valid Quote must include a verifiable price quote source, including vendor names, address, phone numbers, website, email (if applicable), contact person, and all other information necessary for Luxury Travel Rewards to verify that the Savings Challenge is an Apples-to-Apples scenario, and for Luxury Travel Rewards to actually purchase the reservation if desired.
Only price quotes in US Dollars from licensed OTA businesses selling to the General Public qualify to be considered. It is the responsibility of the Member to confirm Luxury Travel Rewards’s receipt of a Savings Challenge by receiving a written acknowledgement from an Luxury Travel Rewards Travel Department Manager by email. In the event a written Savings Challenge acknowledgement is not received within 24 hours of submitting a Savings Challenge, the submitting Member should assume Luxury Travel Rewards did not receive the Savings Challenge and must contact an Luxury Travel Rewards Travel Department Manager immediately and obtain a written acknowledgement of receipt.
For the Savings Challenge to qualify, Luxury Travel Rewards must be able to purchase the offer from the price quote source with all the Reservation components from the same OTA vendor, and at the price quoted, or a lower price. Reservations available through auctions (including charity or other fund raising), through vendors that do not provide the accommodations details until after booking, raffles, promotional specials or from a source making the offer as a temporary or one-time offer (not normally available to the General Public) do not qualify as Valid Quotes or Apples-to-Apples comparisons. When comparing prices, a comparison is understood to mean a comparison between the price charged by Luxury Travel Rewards for the Reservation (after considering all Reservation Price Offsets) and the Valid Quote verified by Luxury Travel Rewards when contacting the Valid Quote source (vendor). Price differences as a result of a fluctuation in currency exchange rates are not accepted as valid Savings Challenges. Price differences as a result of international restrictions are not accepted as valid Savings Challenges.
Compensation: In the event Luxury Travel Rewards fails to provide a Savings pursuant to these Guarantee Terms, the Member shall be entitled to receive 200% of the Failure Difference payable to the Member by Luxury Travel Rewards company check. The term "Failure Difference" is understood to mean the amount in which Luxury Travel Rewards failed in Savings. For example, in the event the Reservation price charged by Luxury Travel Rewards (after considering all Reservation Price Offsets) is greater than the Valid Quote price, and in the event the difference between Luxury Travel Rewards Reservation price and the Valid Quote is $20, the Failure Difference is $20. In this example, Luxury Travel Rewards is obligated to pay the Member $40 ($20 Failure Difference x 200%).
In the event a Member submits more than one Valid Quote related to the same Confirmed Reservation, Luxury Travel Rewards’s obligation to compensate the Member shall be limited to one Valid Quote per Confirmed Reservation (the lowest priced Valid Quote). To qualify for compensation, the Reservation Confirmed through Luxury Travel Rewards (related to the Savings Challenge) cannot be canceled and must be paid in accordance with the terms governing the Confirmed Reservation.
In the event a Member is entitled to compensation as a result of a Savings Challenge, Luxury Travel Rewards’s obligation to compensate the Member shall not be binding upon Luxury Travel Rewards until such time as the Member’s obligation to pay (in full) for the Confirmed Reservation has been met and the associated Reservation travel dates have passed without modification. In the event the Member submitting the Savings Challenge fails to make timely payment to Luxury Travel Rewards for the Reservation being challenged or owes any other monies to Luxury Travel Rewards for any reasons, Luxury Travel Rewards’s obligations hereunder are void. Members submitting two (2) or more frivolous Savings Challenges may be prohibited from submitting future challenges at Luxury Travel Rewards’s sole discretion. This Luxury Travel Rewards Lowest Price Guarantee promotion may be modified and/or discontinued at any time without notice and at Luxury Travel Rewards’s sole discretion, provided that any Savings Challenges received prior to such change(s) shall be processed in accordance with the Guarantee Terms applicable at the time the Savings Challenge was received.
Savings Estimates vs. Actual Savings. This Luxury Travel Rewards Lowest Price Guarantee applies to actual Savings, not estimated savings. In the event Luxury Travel Rewards represents any estimated savings in connection with any Reservation or Reservation offer, such savings shall represent the approximate savings as of the time of the Reservation offer. All such savings estimates are approximate, and Luxury Travel Rewards does not guarantee the accuracy of any such savings estimates.
